St Barts follows French rules on CBD
St Barthélemy is a French overseas collectivity. On narcotics and public health it follows French law, which allows hemp products with up to 0.3% THC (order of 30 December 2021). Since the Conseil d’État decision of 29 December 2022, the sale of hemp flowers under that limit is also allowed.
In practice, tourists can buy and use legal CBD in St Barts just like residents. Cannabis containing more than 0.3% THC remains illegal.
Driving after using CBD is an offence
This is the rule visitors most often miss. CBD flowers and hash can contain traces of THC, and roadside saliva tests detect THC — not CBD. In June 2023, France’s highest court ruled that driving after using a narcotic is an offence whatever the dose. With so many visitors renting cars and scooters on the island, the advice is simple: do not drive, ride or skipper after using CBD.
