Weed in St Barts: Laws, Dispensaries and the Legal CBD Alternative

Updated September 19, 2026 · By the CBD SBH team

The short answer

Weed is not legal in St Barts. St Barthélemy follows French law, under which cannabis containing more than 0.3% THC is a controlled narcotic: buying, possessing or using it is a criminal offence, and there are no legal cannabis dispensaries on the island. What is legal is CBD: hemp flowers, hash and other products containing no more than 0.3% THC, which do not produce the high associated with cannabis. Adult visitors can buy legal CBD in St Barts and have it delivered to their villa or hotel. Whatever you choose, never drive, ride a scooter or skipper a boat after using it, and do not travel with cannabis or CBD flowers to another country.

What the law says

St Barthélemy is a French overseas collectivity and applies French narcotics law. Cannabis with THC above the legal threshold is illegal to buy, possess, use or sell. Tourists are subject to the same rules as residents, and US or Canadian legalization does not apply here.

No. There are no cannabis dispensaries in St Barts, and anyone offering you weed on the island is breaking the law. For legal products, the option is CBD: CBD SBH delivers legal CBD anywhere on the island, 7 days a week from 8am to 10pm.

CBD vs weed: what is the difference?

Both come from the cannabis plant. Weed is rich in THC, the compound responsible for the high. Legal CBD products contain mostly CBD and only traces of THC (0.3% or less), so they do not get you high. They are chosen for their aroma and a relaxing moment, not for intoxication. Three rules for visitors

  • Don’t drive after using CBD: roadside saliva tests detect THC traces, and it is an offence in France (details).
  • Don’t fly with flowers or hash, especially to the US or via Sint Maarten.
  • Be discreet: beaches and the Gustavia harbour are public family places.
